    Does Medical Assistance (Elderly Waiver) cover assisted living in Minnesota?

    Medical Assistance (MA) is Minnesota's Medicaid program. MA itself does not pay for assisted living room and board, but through the Elderly Waiver (EW) it can help cover the care and support services delivered in a licensed assisted living facility. In waiver language, these are called "customized living" services.

    To qualify for the Elderly Waiver, a person generally must:

    • Be age 65 or older
    • Be eligible for Medical Assistance (meeting income and asset limits)

    Assisted living laws and regulations in Minnesota

    Assisted living in Minnesota is licensed and regulated by the Minnesota Department of Health (MDH) through its Health Regulation Division. Under Minnesota Statutes chapter 144G, providers must hold either an Assisted Living Facility license or an Assisted Living Facility with Dementia Care license.

    State law sets standards for how communities operate, including staffing, employee training and background studies, admission and discharge practices, medication management, person-centered service planning, and resident rights. MDH carries out on-site surveys (inspections) and investigates complaints to confirm facilities are following these rules, and it can take enforcement action when they are not.

    Inspection results and complaint findings are public records. Before choosing a community, look up its current license status and review its survey and complaint history using MDH's official tools. Verifying a facility's license and inspection record is one of the most important steps you can take to protect a loved one.
